Introduction

  1. Welcome to the CDL Help Platform (“CDL Help”, “we”, “us”, “our”), a product offered by TruckDriver.help LLC. These Terms and Conditions govern your access to and use of the CDL Help Platform, and all services and features therein. Your use of the platform constitutes your agreement to comply with and be legally bound by these Terms and Conditions, along with any applicable laws and regulations. Please read these terms carefully before accessing or using the platform.

  2. Age Restriction:

    To register for or use the CDL Help Platform, you must be at least 18 years of age. By using the platform, you represent and warrant that you are at least 18 years old.

  3. Geographic Limitations:

    The CDL Help Platform is intended for use solely within the United States. Accessing or using the platform outside the United States is not supported and may be a violation of local laws and regulations.

  4. Competitive Use:

    The platform is designed for use by CDL schools for the primary purpose of receiving calls from potential students. Use of the platform by other competitive services, or any other commercial entity not fitting this description, is strictly prohibited.

  5. Changes to Terms:

    We reserve the right to modify these Terms and Conditions at any time. Your continued use of the platform following any such modification constitutes your acceptance of the updated Terms and Conditions.

  6. Language:

    These Terms and Conditions are written in English. To the extent any translated version of these Terms and Conditions conflicts with the English version, the English version shall prevail.

  7. Contact:

Definitions

  1. Platform:

    Refers to the CDL Help web application, a service facilitated by TruckDriver.help LLC, designed to enable communication between CDL schools and potential students.

  2. User:

    Refers to owners or employees of CDL schools that have registered on the CDL Help Platform. Users are the primary beneficiaries of the services provided and are responsible for the accuracy and legality of the information provided during registration and use of the Platform.

  3. Administrator:

    Refers to the individuals responsible for managing, maintaining, and moderating the CDL Help Platform. Administrators have the right to approve or reject account registrations, assign platform phone numbers, and make decisions related to the operational aspects of the Platform.

  4. Subscription Plans:

    Refers to the different packages of services offered on a monthly basis by the Platform. Subscription Plans may vary in features, costs, and limitations.

  5. Basic and Extra:

    Refer to the types of Subscription Plans offered by the Platform, each with distinct features and costs, as detailed during the subscription process.

  6. Platform Phone Number:

    Refers to the unique phone number generated and assigned to a User's account upon approval by an Administrator. The assignment process takes up to 48 hours but may be delayed due to various circumstances.

Platform Data and Additional Services

  1. Platform Data:

    Refers to all forms of data collected, generated, or displayed by the Platform, including but not limited to call information, analytics, and User information. This data can be used by Users and Administrators for various purposes, as governed by these Terms and Conditions and the Privacy Policy.

  2. Request and Approval Process:

    Refers to the process a User must undergo to request a new or additional Platform Phone Number. Upon submitting a request, an Administrator reviews the request and, if approved, assigns a new Platform Phone Number within the stipulated time.

  3. Extra Plan:

    Refers to a premium type of Subscription Plan offered by the Platform that includes both non-optional and optional services. Users interested in subscribing to or switching to the "Extra" plan must initiate this by sending a request through the Platform. Upon receipt of the request, an employee from TruckDriver.help LLC will engage in a consultation with the User to discuss specific needs and services. Following the consultation, a separate contract outlining the services offered, terms, fees, and other pertinent details will be drafted. This contract must be signed by the User to complete the upgrade to the "Extra" plan. The "Extra" plan is governed by both these Terms and Conditions and the separate contract signed by the User.

Account Registration and Responsibilities

  1. Account Creation:

    To use the CDL Help Platform, you must register for an account. During the registration process, you will be required to provide accurate, current, and complete information as prompted by the registration form.

  2. Password Security:

    Your account will require a password. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Passwords must be at least 8 characters long.

  3. Verification Process:

    All CDL schools that request a subscription to the Platform must undergo a verification process. This may involve verification by phone or email, as well as cross-referencing provided information against the Federal Motor Carrier Safety Administration (FMCSA) portal. Account approval is at the sole discretion of the Platform Administrators.

  4. False Information:

    Providing false, inaccurate, or misleading information with malicious intent is strictly prohibited and may result in immediate termination of your account. Users found to be providing false information may also be banned from using the Platform in the future.

  5. Account Maintenance:

    Users have the ability to edit their account information through the Platform's user interface. While there are no limitations on what information can be edited, changes to specific types of information may require approval or verification from Platform Administrators.

  6. Account Responsibility:

    You are solely responsible for any content or information you provide through the Platform and for ensuring that your use of the Platform is in compliance with these Terms and Conditions and applicable laws.

Subscription Plans and Payments

  1. Available Plans:

    The Platform offers two types of Subscription Plans: "Basic" and "Extra." Each plan provides different levels of service, as outlined during the subscription process and in these Terms and Conditions.

  2. Free Trial:

    New Users are eligible for a 60-day free trial of the "Basic" plan. The trial period begins on the date of account creation and ends after 60 days, at which point the User will automatically be enrolled in a paid "Basic" subscription unless canceled prior to the end of the trial period.

  4. Payment Failure:

    In the event of a payment failure, such as insufficient funds or an expired credit card, the User's service will be canceled. It is the User's responsibility to update payment information to continue using the Platform.

  5. No Refund Policy:

    All subscription fees are final. Generally, the Platform adheres to a no-refund policy. However, each case is reviewed individually, and exceptions may be made at the sole discretion of TruckDriver.help LLC.

  6. Subscription Renewal:

    Subscriptions are set to renew automatically. The day the trial expires or the subscription begins will mark the start of the User's monthly billing cycle. Users are responsible for canceling their subscriptions if they no longer wish to use the service.

  7. Cancellation Policy:

    Users subscribed to the "Basic" plan may cancel their subscriptions at any time without penalty. The terms for canceling the "Extra" plan will be specified in the separate contract signed by the User, as indicated in Section 2.9 of these Terms and Conditions.

Data Collection and Use

  1. Types of Data Collected:

    • School Information: Name, date of establishment, contact details (email, phone number), and any additional information you choose to provide.
    • Multimedia: Photos and videos relating to the school, as provided by Users.
    • User Information: The legal name, contact details (email, phone number), and role in the company of the individual registering the account on behalf of the school.
  2. Purpose of Data Collection:

    The data is collected for the purpose of promoting the registered schools and the CDL Help platform. The collected information may be displayed on various platforms and social media accounts owned by TruckDriver.help LLC.

  3. Data Sharing and Public Availability:

    Most of the School Information will be publicly available to potential students on the CDL Help website. Personal User Information will only be accessed and used by Platform Administrators for internal purposes and will not be shared with third parties.

  4. Data Security:

    While we employ encryption techniques for password security and maintain a secure database, the Platform is still in its early stages. Users should acknowledge that technical issues may arise, and in the case of a data breach, TruckDriver.help LLC cannot be held liable for the consequences.

  5. User Rights:

    Users have the right to access and edit their data through the Platform. Upon request, data can be deleted by reaching out to Platform Administrators.

  6. Compliance:

    The Platform is not GDPR-compliant and is intended for use only within the United States.

User Conduct and Responsibilities

  1. General Behavior:

    Users are expected to use the Platform in a responsible and respectful manner. Any form of abuse, including but not limited to spamming, harassment, and exploiting bugs, is prohibited.

  2. Commercial Use:

    Users are not permitted to use the Platform for any commercial purposes other than those explicitly intended and facilitated by the service.

  3. Data Use Restrictions:

    While Users are allowed to use data provided by the Platform for their purposes, such usage must not involve reselling the data or using it in a manner that directly competes with CDL Help. Any violation of this clause may result in immediate account termination.

  4. Violation Consequences:

    Any violation of the guidelines and restrictions set forth in this section may result in actions taken against the User, up to and including account termination, at the sole discretion of TruckDriver.help LLC.

Termination and Suspension

  1. User-Initiated Termination:

    Users may request to terminate their accounts at any time by communicating with Platform Administrators. Such termination will only take effect after confirmation by the Administrators.

  2. Platform-Initiated Termination:

    TruckDriver.help LLC reserves the right to suspend or terminate any User account that violates these Terms of Service. Additionally, Platform Administrators may, at their sole discretion, decide to discontinue offering services to a User. Users will be notified in advance of any such termination or suspension.

  3. Data Retention:

    Upon termination, all User data will be archived for a period of six months before full deletion, unless otherwise required by law or relevant authorities.

  4. Fees:

    Termination of an account will not incur any fees, provided the User does not have outstanding payments or other obligations to TruckDriver.help LLC.

Limitation of Liability and Disclaimers

  1. No Warranties:

    The services provided by TruckDriver.help LLC and the CDL Help Platform are provided "as is," without any warranties or guarantees of performance, availability, or suitability for a particular purpose.

  2. Limitation of Liability:

    To the fullest extent permitted by law, TruckDriver.help LLC shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, or other intangible losses, arising out of or in connection with your use of the Platform.

  3. Technical Issues:

    Users acknowledge that technical issues may arise, causing the Platform to be temporarily unavailable. TruckDriver.help LLC will not be liable for any losses or damages resulting from such downtime.

  4. Dispute Resolution:

    Any disputes arising out of the use of the Platform may be resolved through arbitration or court proceedings, as decided by TruckDriver.help LLC.

Intellectual Property

  1. User Content:

    Users may upload content to the Platform to provide additional information about their schools. All content uploaded by Users remains the property of the respective Users. By uploading content, Users grant TruckDriver.help LLC a non-exclusive, royalty-free, and transferable license to use, display, and distribute said content for the purpose of providing and improving the services of the CDL Help Platform.

  2. Platform Content:

    Except for User-generated content, all materials, including but not limited to text, data, graphics, logos, and software used on this Platform are the property of TruckDriver.help LLC or its licensors and are subject to copyright, trademark, and other intellectual property laws.

  3. Restrictions:

    Users are not permitted to share, redistribute, sell, or otherwise use any materials or data from the Platform for any purposes other than those explicitly stated in these Terms and Conditions.

Miscellaneous

  1. Governing Law:

    These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

  2. Notifications:

    Users will be notified of any changes to these Terms and Conditions via email. While notifications may also appear on the Platform, email shall be the primary method of communication for such updates.

  3. Force Majeure:

    TruckDriver.help LLC shall not be held liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, wars, terrorism, natural disasters, or any other event that could not be anticipated or controlled.

  4. Entire Agreement:

    These Terms and Conditions constitute the entire agreement between you and TruckDriver.help LLC, superseding any prior agreements or understandings, oral or written, between you and TruckDriver.help LLC concerning the subject matter herein.

Effective Date

By using the CDL Help Platform provided by TruckDriver.help LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
